廣州市交通運(yùn)輸局關(guān)于進(jìn)一步優(yōu)化普通公路招投標(biāo)管理等工作的通知（Notice of Guangzhou Municipal Transportation Bureau on Further Improving the Work Related to the Administration of Tendering and Bidding for General Highway Projects）穗交運(yùn)函〔2021〕548號市道路養(yǎng)護(hù)中心，白云區(qū)、黃埔區(qū)、花都區(qū)、番禺區(qū)、南沙區(qū)、從化區(qū)、增城區(qū)交通運(yùn)輸局：　　為進(jìn)一步優(yōu)化普通公路建設(shè)市場營商環(huán)境，按照“簡化流程，縮短時間，減少成本”的原則，現(xiàn)就普通公路招投標(biāo)管理等相關(guān)工作通知如下：　　一、我市從2019年至今出臺的普通公路養(yǎng)護(hù)工程招投標(biāo)改革政策擴(kuò)大適用于普通公路新建、改擴(kuò)建項(xiàng)目。　　二、招標(biāo)計(jì)劃的發(fā)布　　普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目依法必須進(jìn)行招標(biāo)的，應(yīng)在公共資源交易平臺或其他公共媒介向社會發(fā)布招標(biāo)計(jì)劃，發(fā)布時間為招標(biāo)公告發(fā)布之日前至少30日，切實(shí)增強(qiáng)招標(biāo)工作透明度。　　三、推行招投標(biāo)全流程電子化　　繼續(xù)深入推進(jìn)招投標(biāo)全流程電子化，大力推廣遠(yuǎn)程評標(biāo)、合同在線簽署、工程款項(xiàng)支付、工程驗(yàn)收管理等功能的應(yīng)用，提高招標(biāo)和合同管理效率。　　四、取消資格預(yù)審　　除技術(shù)復(fù)雜或特殊要求的工程外，普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目招投標(biāo)原則上不再進(jìn)行任何形式的資格預(yù)審。　　五、取消投標(biāo)保證金及履約保證金　　普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目招投標(biāo)原則上取消投標(biāo)保證金及履約保證金，推行以廣東省交通運(yùn)輸廳、廣州市交通運(yùn)輸局開展的公路從業(yè)單位信用評價結(jié)果替代上述保證金。　　六、提升開工效率　　（一）及時簽訂合同。普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目要在發(fā)放中標(biāo)通知書后7天內(nèi)簽訂合同，鼓勵以電子合同代替紙質(zhì)合同。除發(fā)生不可抗力因素以外，招標(biāo)人和中標(biāo)人不得再訂立背離合同實(shí)行內(nèi)容的其他協(xié)議。　　（二）下達(dá)開工通知。招標(biāo)人收到相關(guān)材料后應(yīng)于2天內(nèi)完成相關(guān)的手續(xù)辦理，督促監(jiān)理單位及時下達(dá)開工通知，并按照有關(guān)規(guī)定及時通過交通運(yùn)輸主管部門網(wǎng)站向社會公告施工信息。　　七、嚴(yán)格合同變更管理　　（一）嚴(yán)格合同變更。普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目原則上不得發(fā)生重大變更，確需變更的，招標(biāo)人應(yīng)嚴(yán)格履行變更程序。　　（二）規(guī)范重新談判和招標(biāo)。普通公路新建、改擴(kuò)建及養(yǎng)護(hù)工程項(xiàng)目變更內(nèi)容涉及工程造價增加未達(dá)到簽約合同價10%的，直接按合同條款調(diào)整；累計(jì)金額達(dá)到簽約合同價10%—30%或超過30%但未超過400萬元的，對新增加內(nèi)容進(jìn)行談判；累計(jì)金額超過簽約合同價30%且超過400萬元的，對新增內(nèi)容重新招標(biāo)，但新增加內(nèi)容為與原工程不可分割的工程，經(jīng)交通運(yùn)輸主管部門審核同意后可以不用重新招標(biāo)。　　特此通知。　　廣州市交通運(yùn)輸局　　2021年11月4日　　（此件公開發(fā)布）Notice of Guangzhou Municipal Transportation Bureau on FurtherImproving the Work Related to the Administration of Tendering and Bidding for General Highway ProjectsS.J.Y.H. [2021] No. 548Guangzhou Road Maintenance Center, and the Transportation Bureaus of Baiyun District, Huangpu District, Huadu District, Panyu District, Nansha District, Conghua District and Zengcheng District:　　According to the principle of “streamliningprocedures, shortening handling time and lowering cost”, we hereby issue the following notice on the work related to the administration of tendering and bidding for general highway projects, for the purpose of improving the business environment for general highway construction:　　I. The reform policies introduced by Guangzhou since 2019 on the tendering and bidding for general highway maintenance projects shall be further applied to general highway construction, renovation and expansion projects.　　II. Release ofBidding Plans　　Where bidding isrequired by law for a general highway construction, renovation, expansion or maintenance project, a bidding plan shall be released to the public on the public resources trading platforms or other public media at least 30 days prior to the date of the announcement of the bidding, so as to enhance the transparency of the bidding work.　　III. Whole-process Electronized Bidding　　Thewhole-process electronized bidding will be further promoted, and applications such as remote evaluation of bids, online signing of contracts, payment of project funds and project acceptance inspection management will be vigorously promoted, so as to improve the efficiency of bidding and contract management.　　IV. Cancellation of Prequalification　　Except for the projects requiring complex technologies or with special requirements, the bidding for general highway construction, renovation, expansion and maintenance projects will, in principle, no longer be subject to any form of prequalification.　　V. Cancellation ofTender Security and Performance Security 　　For the bidding for general highway construction, renovation, expansion and maintenance projects, the tendering party will, in principle, no longer need to pay tender security and performance security; instead, the highway project practicing entity credit evaluation carried out by the Department of Transport of Guangdong Province and Guangzhou Municipal Transportation Bureau will be implemented to replace the aforesaid tender security and performance security.　　VI. Improvement of Project Commencement Efficiency　　(I) Signing contracts in a timely manner. For general highway construction, renovation, expansion and maintenance projects, the contracts must be signed within 7 days after the issuance of the notification of award; and it is encouraged to replace paper contracts with electronic ones. Except for force majeure, the tenderee and the bid winner shall not enter into any other agreement that goes against the content of the contracts signed.　　(II) Issuing the notice on the commencement of construction. The tenderee shall go through relevant formalities within 2 days upon receipt of the relevant materials, urge the supervision organization to issue the notice on the commencement of construction without delay, and announce information about the construction project(s) to the public on the website of the competent transportation department according to relevant regulations in a timely manner.　　VII. Strengthening the Management of Change of Contract　　(I) Procedures concerning change of contract shall be strictly followed. In principle, no major change shall be made to general highway construction, renovation, expansion and maintenance projects; where such change is necessary, the tenderee shall strictly follow the procedures concerning change of contract.　　(II) Renegotiation and bid invitation shall be strictly regulated. If the change of a general highway construction, renovation, expansion or maintenance project involves an increase in cost by less than 10% of the contractual price, adjustment can be made directly in accordance with the terms of the contract; if the total amount involved reaches 10%-30% of the contractual price or if it exceeds 30% but is less than RMB 4 million, negotiation shall be conducted on the newly added content; if the total amount involved exceeds 30% of the contractual price and is more than RMB 4 million, a new invitation for bid shall be made for the newly added content; however, if the newly added content is inseparable from the original project, the new invitation for bid may not be required, subject to review and approval of the competent transportation department.　　It is hereby notified.　　Guangzhou Municipal Transportation Bureau (seal)　　November 4, 2021
